Vzh\u013eadom ku st\u00e1le opakuj\u00facim sa nedostatkom v n\u00e1vrhu z\u00e1kona aj napriek niektor\u00fdm nov\u00fdm \u00faprav\u00e1m, napr. certifik\u00e1cii firiem pre vyhotovovanie vyhraden\u00fdch stavieb a pritom nikto nevie \u010do s\u00fa vyhraden\u00e9 stavby, nejasnostiach v defin\u00edci\u00e1ch \u010do s\u00fa v\u00f4bec stavby a bytov\u00e9 stavby, zotrv\u00e1vanie na zru\u0161en\u00ed stavebn\u00fdch \u00faradov a ich nahraden\u00edm ak\u00fdmsi stavebn\u00fdm komis\u00e1rom s nejasn\u00fdmi pr\u00e1vami, povinnos\u0165ami a zodpovednos\u0165ou s kone\u010dn\u00fdm negat\u00edvnym dopadom na obce, preto\u017ee tie nebud\u00fa ma\u0165 preh\u013ead o pripravovan\u00fdch a vykon\u00e1van\u00fdch stavb\u00e1ch na ich \u00fazem\u00ed, sme odmietli tieto a \u010fal\u0161ie nezmyseln\u00e9 \u00fapravy, ktor\u00e9 pod\u013ea na\u0161ich anal\u00fdz neved\u00fa k ni\u010domu dobr\u00e9mu pre stavebn\u00edctvo a n\u00e1\u0161 \u0161t\u00e1t. Odmietame zru\u0161enie stavebn\u00fdch \u00faradov v mest\u00e1ch a vybran\u00fdch obciach, naopak, je potrebn\u00e9 ich posili\u0165 !!<\/p>\n<p>&nbsp;<\/p>\n<p>Taktie\u017e sme vytkli viacero form\u00e1lnych, ale s vecn\u00fdm pr\u00e1vnym obsahom nespr\u00e1vnos\u0165 a rozpornos\u0165 vym\u00fd\u0161\u013eania nelogick\u00fdch n\u00e1zvov z\u00e1kona a v z\u00e1kone, a niektor\u00fdch defin\u00edci\u00ed v rozpore s nadv\u00e4zuj\u00facimi z\u00e1konmi, a to napr. namiesto n\u00e1zvu Z\u00e1kon o stavebnom poriadku, ktor\u00fd pozn\u00e1 kompeten\u010dn\u00fd z\u00e1kon a pod. tvorca vymyslel ni\u010d nehovoriaci z\u00e1kon V\u00ddSTAVBA, Stavebn\u00fd dozorca (dozorcovia s\u00fa vo v\u00e4zniciach a nie na stavb\u00e1ch) a pod.<\/p>\n<p>&nbsp;<\/p>\n<p>\u010ealej trv\u00e1me na tom:<\/p>\n<p>a) aby sa ka\u017ed\u00e1 stavba vyhotovila len na z\u00e1klade vykon\u00e1vacieho projektu bez oh\u013eadu na to ak\u00e1 je to stavba;<\/p>\n<p>b) \u017ee stavebn\u00fd dozor je kontroln\u00fd in\u0161tit\u00fat nad mno\u017estvom, spr\u00e1vnos\u0165ou a cenou vykon\u00e1van\u00fdch pr\u00e1c, a nie osoba, ktor\u00e1 riadi v\u00fdstavbu rodinn\u00e9ho domu svojpomocou, \u010do je absol\u00fatny nezmysel, a mus\u00ed by\u0165 na ka\u017edej stavbe bez oh\u013eadu na to ak\u00e1 je to stavba;<\/p>\n<p>c) \u017ee, stavebn\u00e9 remeseln\u00e9 pr\u00e1ce m\u00f4\u017eu vykon\u00e1va\u0165 len remeselne vzdelan\u00ed a pripraven\u00ed pracovn\u00edci, atd !<\/p>\n<p>&nbsp;<\/p>\n<p>Taktie\u017e sme ofici\u00e1lne spochybnili z\u00e1konnos\u0165 vyd\u00e1van\u00fdch osved\u010den\u00ed Stavbyved\u00faci a Stavebn\u00fd dozor. Vo veci vyd\u00e1vania a osved\u010dovania odbornej sp\u00f4sobilosti pre kvalifik\u00e1ciu Stavebn\u00fd dozor a Stavbyved\u00faci trv\u00e1me na dodr\u017eiavan\u00ed \u017eivnostensk\u00e9ho z\u00e1kona a z\u00e1kona o celo\u017eivotnom vzdel\u00e1van\u00ed. S\u00fa\u010dasne oznamujeme, \u017ee sme 23 marca 2018 podali podnet na gener\u00e1lnu prokurat\u00faru na pre\u0161etrenie rozporov v z\u00e1kone \u010d. 138\/1992 Zb.\u00a0\u00a0 <span class=\"st\"> &#8211; Z\u00e1kon Slovenskej n\u00e1rodnej rady o autorizovan\u00fdch architektoch a autorizovan\u00fdch stavebn\u00fdch in\u017einieroch<\/span> so <span class=\"st\">z\u00e1konom \u010d. 568\/2009 Z. z. &#8211; Z\u00e1kon o celo\u017eivotnom vzdel\u00e1van\u00ed a o zmene a doplnen\u00ed niektor\u00fdch z\u00e1konov, z\u00e1konom \u010d. 455\/1991 Zb. &#8211; Z\u00e1kon o \u017eivnostenskom podnikan\u00ed a s Eur\u00f3pskymi smernicami pre stavebn\u00edctvo.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>Navrhli sme ako podmienku ma\u0165 v ka\u017edom meste hlavn\u00e9ho architekta ako z\u00e1konn\u00fa povinnos\u0165.<\/p>\n<p>&nbsp;<\/p>\n<p>Predsedn\u00edctvu komisie sme ozn\u00e1mili, \u017ee trv\u00e1me na na\u0161ich aj tu neuveden\u00fdch po\u017eiadavk\u00e1ch a n\u00e1vrhoch a trv\u00e1me na zmene doteraj\u0161ej koncepcie a n\u00e1zvu nasledovne:<\/p>\n<p style=\"text-align: center;\">&#8222;Z\u00e1kon o Urbanizme a \u00fazemnom pl\u00e1novan\u00ed&#8220; a Z\u00e1kon o Stavebnom poriadku&#8220; !<\/p>\n<p>Medzi in\u00fdm sme po\u017eiadali ministersk\u00fdch \u00faradn\u00edkov predlo\u017ei\u0165 kone\u010dne legislat\u00edvny z\u00e1mer ku tomuto z\u00e1konu, ktor\u00fd zatia\u013e predlo\u017een\u00fd nebol, preto\u017ee medi\u00e1lne proklamovan\u00e9 zd\u00f4vodnenie potreby nov\u00e9ho z\u00e1kone nie je legislat\u00edvny z\u00e1mer.<\/p>\n<p>K na\u0161im pripomienkam a n\u00e1vrhom neboli prakticky \u017eiadne podstatn\u00e9 pripomienky a n\u00e1mietky okrem z\u00e1kona o urbanizme, ktor\u00e9mu sa nelogicky tvorcovia br\u00e1nia a vyh\u00fdbaj\u00fa.
