Majite\u013e pozemku a investor sa zrejme na\u0161tval a osadil tam 16 lodn\u00fdch oce\u013eov\u00fdch kontajnerov d\u00fafaj\u00fac, \u017ee prejde cez rozum \u00faradn\u00edkom pramiatkov\u00e9ho a stavebn\u00e9ho \u00faradu. Kontajnery moment\u00e1lne zatepluje a vytvor\u00ed z nich objekt na b\u00fdvanie, pr\u00edpadne kancel\u00e1rie alebo nie\u010do podobn\u00e9. Pod\u013ea vlastn\u00e9ho vyjadrenia majite\u013e pozemku predpoklad\u00e1, \u017ee nepotrebuje stavebn\u00e9 povolenie ani ohl\u00e1senie, je to jeho pozemok a on bude rozhodova\u0165 \u010do tam bude a nebude.<\/p>\n<p>Stavebn\u00fd \u00farad u\u017e vyr\u00fabil pokutu v ni\u017e\u0161ej sadzbe vo v\u00fd\u0161ke 25 000,00 \u20ac, ale stavebn\u00edk sa odvolal s t\u00fdm, \u017ee nejde o stavbu, lebo polo\u017een\u00e9 kontajnery na plochu nie s\u00fa stavbou, preto nem\u00f4\u017ee plati\u0165 ani \u00faradn\u00e9 nariadenie o odstr\u00e1nen\u00ed nepovolenej stavby.<\/p>\n<p>Ak by stavebn\u00edk aj vyhotovil stavebn\u00fd objekt bez pevn\u00e9ho spojenia s p\u00f4dou, alebo spevnenou plochou nem\u00e1 pod\u013ea EU smernice a\u00a0 oddielu 3 &#8222;V\u0160EOBECN\u00c9 TECHNICK\u00c9 PO\u017dIADAVKY NA V\u00ddSTAVBU&#8220; z\u00e1kona \u010d. 50\/1976 Zb. <span class=\"h1a\">Z\u00e1kon o \u00fazemnom pl\u00e1novan\u00ed a stavebnom poriadku (stavebn\u00fd z\u00e1kon) <\/span>\u0161ancu objekt skolaudova\u0165 a uvies\u0165 do u\u017e\u00edvania, preto\u017ee nem\u00e1 ako splni\u0165 dan\u00e9 podmienky <span class=\"h1a\">. <\/span>T\u00fdm v\u0161ak netvrd\u00edme, \u017ee z tak\u00fdchto kontajnerov sa nedaj\u00fa zhotovi\u0165 aj obytn\u00e9 alebo podobn\u00e9 objekty! Daj\u00fa sa, ale musia sa vykona\u0165 nevyhnutn\u00e9 technick\u00e9 \u00fapravy, ktor\u00e9 musia splni\u0165 Slovensk\u00e9 a EU podmienky pre stavby a ich riadne u\u017e\u00edvanie.<\/p>\n<p>V tejto s\u00favislosti by si mal ka\u017ed\u00fd stavebn\u00fd investor uvedomi\u0165, \u017ee v\u0161ade na svete mus\u00ed re\u0161pektova\u0165 podmienky pamiatkov\u00fdch \u00faradov alebo komisi\u00ed a stavebn\u00fdch \u00faradov. \u017dia\u013e po roku 1992 a hlavne po roku 1995 nast\u00e1vaj\u00fa \u010dasy legislat\u00edvnej anarchie na Slovensku do tak\u00e9ho \u0161t\u00e1dia, \u017ee z mnoh\u00fdch z\u00e1konov sa stali trhacie kalend\u00e1re, ne s\u00fa previazan\u00e9 a syst\u00e9mov\u00e9, preto aj vymo\u017eite\u013enos\u0165 pr\u00e1va napr. v stavebn\u00edctve sa v mnoh\u00fdch pr\u00edpadoch st\u00e1va il\u00faziou.<\/p>\n<p>V tomto pr\u00edpade investor mo\u017eno z\u00edska nejak\u00fd do\u010dasn\u00e9, pr\u00e1vne alebo komer\u010dn\u00e9 v\u00ed\u0165azstvo. S vysokou pravdepodobnos\u0165ou a\u017e s istootu v kone\u010dnom d\u00f4sledku to bude &#8222;Pyrhovo v\u00ed\u0165azstvo&#8220;, ak ho v\u00f4bec z\u00edska. Mesto m\u00e1 toti\u017e aj in\u00e9 legislat\u00edvne mo\u017enosti, ktor\u00e9\u00a0 m\u00f4\u017ee e\u0161te pou\u017ei\u0165. V tak\u00fdchto pr\u00edpadoch pod\u013ea sk\u00fasenost\u00ed na\u0161ej komory je najrozumnej\u0161ia dohoda s \u00fastupom stavebn\u00edka a nie str\u00e1ca\u0165 \u010das, energiu a peniaze v prehranom boji. Pravidl\u00e1 v\u00fdstavby a z\u00e1kony, aj ke\u010f be\u017en\u00fdm stavebn\u00edkom komplikuj\u00fa &#8222;\u017eivot&#8220;\u00a0 treba dodr\u017eiava\u0165, \u010di sa n\u00e1m to p\u00e1\u010di lebo nie, inak to ve\u013ea stoj\u00ed a kone\u010dn\u00fd efekt pri vynalo\u017een\u00fdch n\u00e1kladoch zvy\u010dajne sporn\u00fd a zbyto\u010dn\u00e1 strata.<\/p>\n<p>Pod\u013ea doteraj\u0161ieho priebehu pr\u00edpadu je mo\u017en\u00e9 predpoklada\u0165 , \u017ee spor sa bude stup\u0148ova\u0165, ale m\u00e1m za to, \u017ee je to absol\u00fatne zbyto\u010dn\u00e9, preto\u017ee tu ide zrejme pocit vlastnej nadradenosti vlastn\u00edka pozemku nad spolo\u010densk\u00fdmi z\u00e1ujmami a o ne\u00factu k vlastn\u00e9mu mestu, k jeho hist\u00f3rii a k jeho ob\u010danom.<\/p>\n<p>V tejto s\u00favislosti je mo\u017en\u00e9 mnoh\u00e9 rozhodnutia vytkn\u00fa\u0165 aj povoleniam na stavb\u00e1m na Mostnej ulici oproti &#8222;par\u010d\u00edku&#8220; pri divadle z rokov 1995 a\u017e doposia\u013e, ktor\u00fdch architekt\u00fara sotva kore\u0161ponduje s touto historickou z\u00f3nou. \u017dia\u013e plat\u00ed to aj pre divadlo, ktor\u00e9 je architektonicky na dan\u00fa dobu perfektne zvl\u00e1dnut\u00e9 ale zni\u010dilo historick\u00e9 jadro mesta s jedine\u010dn\u00fdmi stavbami v r\u00e1mci Slovenska a Rak\u00fasko-Uhorska a do tohto prostredia v\u00f4bec nepatr\u00ed podobne ako aj n\u00e1kupn\u00fd dom Mlyny! \u017dia\u013e st\u00e1le sme sa nevyrovnali s neblah\u00fdm myslen\u00edm z \u010dias komunizmu a nem\u00e1me \u00factu k p\u00f4vodnej architekt\u00fare a stavebn\u00fdm mestsk\u00fdm pamiatk\u00e1m, ktor\u00e9 najlep\u0161ie hmotne a vizu\u00e1lne reprezentuj\u00fa na\u0161u hist\u00f3riu. \u00dactu k miestu kde \u017eijem sme patriotizmus a spolupatri\u010dnos\u0165 nahradili komerciou, ziskom a sebectvom s pocitom svojej v\u00fdnimo\u010dnosti a nadradenosti. V minulosti to bola ideol\u00f3gia a likvid\u00e1cia Slovenskej stavebnej hist\u00f3rie pod presadzovanou dogmou, \u017ee Slov\u00e1ci s\u00fa mlad\u00fd n\u00e1rod bez hist\u00f3rie. Teraz je to moc pe\u0148az\u00ed, komercie ale aj necitlivosti na\u0161ich architektov a ch\u00fdbaj\u00facich pravidiel urbanistick\u00e9ho pl\u00e1novania miest a obc\u00ed.
