Bude to doteraj\u0161\u00ed \u201eZ\u00e1kon o\u00a0\u00fazemnom pl\u00e1novan\u00ed\u201c a \u201eZ\u00e1kon o\u00a0v\u00fdstavbe\u201c namiesto p\u00f4vodn\u00e9ho n\u00e1zvu Z\u00e1kona o stavebnom poriadku.<\/p>\n<p>Na\u0161a komora m\u00e1 k\u00a0pripravovan\u00fdm pr\u00e1vnym \u00faprav\u00e1m viac v\u00e1\u017enych a\u00a0z\u00e1sadn\u00fdch pripomienok ale spomeniem aspo\u0148 tie z\u00e1kladn\u00e9:<\/p>\n<p><strong>1\/ Z\u00e1kon o\u00a0\u00fazemnom pl\u00e1novan\u00ed :<\/strong><\/p>\n<p>Objekt\u00edvne treba uzna\u0165, \u017ee tvorcovia \u010dasti n\u00e1vrhu stavebnej legislat\u00edvy o\u00a0\u00fazemnom pl\u00e1novan\u00ed navrhuj\u00fa ur\u010dit\u00fd zjednodu\u0161en\u00fd sp\u00f4sob \u00fazemn\u00e9ho konania, ktor\u00fd by mal by\u0165 v\u00a0kone\u010dnom d\u00f4sledku pr\u00ednosom pre skr\u00e1tenie tohto procesu. Na\u0161a komora toto pova\u017euje za pr\u00ednos<strong>, z\u00e1sadne v\u0161ak trv\u00e1me na tom, aby z\u00e1kladn\u00fdm pilierom pl\u00e1novania akejko\u013evek v\u00fdstavby bol <u>z\u00e1v\u00e4zn\u00fd urbanistick\u00fd dokument <\/u>&#8211; generel silou z\u00e1kona na obdobie najmenej 20-25 rokov.<\/strong> Vzh\u013eadom na zdevastovan\u00e9 pr\u00e1vne povedomie politikov a\u00a0u\u017e aj ob\u010danov, mus\u00ed to by to by\u0165 \u201e<strong>Z\u00e1kon o\u00a0urbanizme<\/strong>\u201c.\u00a0 Stavebn\u00e1 komora SR ho m\u00e1 pripraven\u00fd, pon\u00fakla ho na rokovanie, ale ministersk\u00ed \u00faradn\u00edci odmietli o tomto n\u00e1vrhu diskutova\u0165.<\/p>\n<p><strong>Z\u00e1kon o\u00a0urbanizme ur\u010d\u00ed, stabilizuje a\u00a0zavia\u017ee vl\u00e1dy, VUC, okresy, mest\u00e1 a\u00a0obce dodr\u017eiava\u0165 n\u00e1rodno-\u0161t\u00e1tnu politiku rozvoja Slovenska vo v\u0161etk\u00fdch z\u00e1kladn\u00fdch rozvojov\u00fdch ot\u00e1zkach Slovenskej republiky ako \u0161t\u00e1tu. <\/strong>To znamen\u00e1, \u017ee ur\u010d\u00ed dlhodob\u00e9 rozvojov\u00e9 najmenej 20-25 ro\u010dn\u00e9 smerovanie hospod\u00e1rskej, ekonomickej, priemyselnej, bezpe\u010dnostnej, zamestnaneckej, zdravotnej, soci\u00e1lnej, vzdelanostnej, bytovej, enviroment\u00e1lnej, po\u013enohospod\u00e1rskej\u00a0 a\u00a0potravinovej politiky, o\u00a0ktorej politici desiatky rokov kr\u00e1sne hovoria, ale ni\u010d pre to nerobia a\u00a0neust\u00e1le hasia probl\u00e9my tvoren\u00edm \u010fal\u0161\u00edch probl\u00e9mov. T\u00fdmto z\u00e1konom sa s\u00fa\u010dasn\u00fd charakter Slovenska z\u00a0realitnej kancel\u00e1rie s najv\u00e4\u010d\u0161\u00edm stavebn\u00fdm pozemkom pre priemysel zmen\u00ed na \u0161t\u00e1t s\u00a0ucelenou rozvojovou a\u00a0stabilnou politikou pre Slov\u00e1kov a\u00a0v\u0161etk\u00fdch ob\u010danov.\u00a0 <strong>Z\u00e1kon o\u00a0urbanizme a\u00a0urbanizmus samotn\u00fd je z\u00e1kladom pre \u00fazemn\u00e9 pl\u00e1novanie!<\/strong> Dokonca aj n\u00e1vrh z\u00e1kona o\u00a0\u00fazemnom pl\u00e1novan\u00ed\u00a0 MDaV sa miestami odvol\u00e1va na urbanizmus, ale nechce ho ma\u0165 taxat\u00edvne upraven\u00fd v\u00a0legislat\u00edve. Pre\u010do, to nie je \u0165a\u017ek\u00e9 si domyslie\u0165.\u00a0 Preto aj na tomto mieste pripom\u00edname ministerstvu, \u017ee trv\u00e1me na z\u00e1konnej \u00faprave urbanizmu bu\u010f ako samostatn\u00fd Z\u00e1kon, alebo zl\u00fa\u010den\u00fd ako Z\u00e1kon o\u00a0urbanizme a\u00a0\u00fazemnom pl\u00e1novan\u00ed!!<strong> Je u\u017e po dvan\u00e1stej hodine za\u010da\u0165 chr\u00e1ni\u0165 po\u013enohospod\u00e1rsku p\u00f4du, vodn\u00e9 zdroje, lesy, \u017eivotn\u00e9 prostredie v\u00f4bec a\u00a0da\u0165 Slovensku dlhodob\u00fa rozvojov\u00fa politiku. Potom nemus\u00edme rie\u0161i\u0165 odchod na\u0161ich det\u00ed za pr\u00e1cou do z\u00e1padn\u00fdch \u0161t\u00e1tov EU a dovoz pracovnej sily z\u00a0menej vyspel\u00fdch \u0161t\u00e1tov do zahrani\u010dn\u00fdch montovn\u00ed, skladov a\u00a0in\u00fdch prev\u00e1dzok na Slovensku v\u010faka ch\u00fdbaj\u00facej rozvojovej politiky \u0161t\u00e1tu a Slovensk\u00e9ho stavebn\u00edctva.<\/strong><\/p>\n<p><strong>2\/ Z\u00e1kon o\u00a0v\u00fdstavbe:<\/strong><\/p>\n<p>Na\u0161a komora po\u010das v\u0161etk\u00fdch rozhovorov o\u00a0z\u00e1kone v\u00a0MDaV, jasne a\u00a0nie raz definovala nes\u00fahlas s\u00a0navrhovan\u00fdm paragrafov\u00fdm znen\u00edm aj s\u00a0d\u00f4voden\u00edm, \u017ee nerie\u0161i probl\u00e9my s\u00fa\u010dasnej praxe a bud\u00facnosti. Autori n\u00e1vrhu v\u0161ak minim\u00e1lne dbali na na\u0161e n\u00e1vrhy, ale aj na n\u00e1vrhy in\u00fdch \u00fa\u010dastn\u00edkov. \u00a0Na\u0161a Stavebn\u00e1 komora m\u00e1 okrem in\u00e9ho z\u00e1sadn\u00e9 v\u00fdhrady ku kozmetickej zmene n\u00e1zvu zo stavebn\u00e9ho\u00a0poriadku na ni\u010d nehovoriaci \u201eZ\u00e1kon o\u00a0v\u00fdstavbe\u201c, a\u00a0to aj preto, \u017ee kompeten\u010dn\u00fd z\u00e1kon nepozn\u00e1 pojem \u201eV\u00fdstavba\u201c, pozn\u00e1 len stavebn\u00fd poriadok a \u0161tat\u00fat Ministerstva dopravy a\u00a0v\u00fdstavby pozn\u00e1 tie\u017e len \u201eZ\u00e1kon o\u00a0stavebnom poriadku\u201c. Nes\u00fahlas\u00edme tie\u017e s\u00a0odobrat\u00edm kompetenci\u00ed a\u00a0prenesen\u00fd v\u00fdkon \u0161t\u00e1tnej moci zo stavebn\u00fdch \u00faradov na nov\u00fd nezn\u00e1my a nezau\u017e\u00edvan\u00fd in\u0161tit\u00fat v\u00a0povo\u013eovacom konan\u00ed stavieb tzv. \u201eStavebn\u00fd komis\u00e1r\u201c, ktor\u00fd \u00fadajne skr\u00e1ti a\u00a0zjednodu\u0161\u00ed stavebn\u00e9 konanie&#8230; Autori toho n\u00e1vrhu a\u00a0v\u00fdmyslu funkcie \u201estavebn\u00e9ho komis\u00e1ra\u201c zveruj\u00fa \u0161t\u00e1tnu moc fyzickej osobe, ktor\u00fa ani sami autori nevedia presne definova\u0165, \u010di to bude \u017eivnostn\u00edk, \u0161t\u00e1tny zamestnanec, zamestnanec obce, alebo kto!&#8230; Vraj sa to vyrie\u0161i vyhl\u00e1\u0161kou! Zaveden\u00edm stavebn\u00fdch komis\u00e1rov bude pod\u013ea n\u00e1zoru expertov na\u0161ej komory v\u00a0re\u00e1lnej praxi\u00a0 doslova \u201eEur\u00f3psky experiment\u201c, a\u00a0pri s\u00fa\u010dasnom zru\u0161en\u00ed vyd\u00e1vania stavebn\u00fdch povolen\u00ed na jednoduch\u00e9 stavby doslova hazardom v\u00a0stavebnej praxi! \u013dahko sa m\u00f4\u017ee sta\u0165, \u017ee prim\u00e1tori a\u00a0starostovia obc\u00ed nebud\u00fa ma\u0165 tu\u0161enie, \u010do za stavby\u00a0 to vyrastaj\u00fa v\u00a0ich mest\u00e1ch a\u00a0obciach. Bude tie\u017e ve\u013emi zauj\u00edmav\u00e9 sledova\u0165, ako bud\u00fa s\u00fady rie\u0161i\u0165 pochybenia t\u00fdchto os\u00f4b a ako \u00a0MDaV SR v\u00a0zmysle Programov\u00e9ho vyhl\u00e1senia vl\u00e1dy v\u00a0Protikorup\u010dnej dolo\u017eke MDaV SR dolo\u017e\u00ed a zd\u00f4vodn\u00ed pr\u00ednos komis\u00e1ra v\u00a0Stavebnom konan\u00ed v\u00a0odstra\u0148ovan\u00ed korupcie&#8230;<\/p>\n<p>N\u00e1vrh z\u00e1kona MDaV v\u00f4bec nerie\u0161i podmienky na zv\u00fd\u0161enie kvality projektov\u00fdch, kontroln\u00fdch \u00a0a\u00a0vykon\u00e1vac\u00edch \u2013 aplika\u010dn\u00fdch remeseln\u00fdch odborn\u00fdch pr\u00e1c na stavb\u00e1ch. Nerie\u0161i kontrolu projektov, nerie\u0161i obsah vyhotovenia projektov pre urbanizmus, nedostato\u010dne rie\u0161i obsah pre \u00fazemn\u00e9 pl\u00e1novanie a\u00a0hlavne v\u00f4bec nerie\u0161i stupne projektov a\u00a0ich obsah pre v\u00fdstavbu \u2013 uskuto\u010d\u0148ovanie stavieb. Definovanie zodpovednosti projektanta a jej rozsahu n\u00e1vrh z\u00e1kona nerie\u0161i prakticky v\u00f4bec.<\/p>\n<p>N\u00e1vrh z\u00e1kona v\u00f4bec nerie\u0161i jednozna\u010dn\u00fa podmienku zhotovovania stavieb priamo na stavb\u00e1ch kvalifikovan\u00fdmi osobami v\u00a0aplika\u010dn\u00fdch \u2013 remeseln\u00fdch \u010dinnostiach. Nem\u00f4\u017eeme s\u00fahlasi\u0165 so v\u0161eobecnou defin\u00edciou \u201eodborne sp\u00f4sobil\u00e9\u201c osoby!<\/p>\n<p>N\u00e1vrh z\u00e1kona v\u00f4bec nerie\u0161i\u00a0 z\u00e1sadn\u00fa a\u00a0principi\u00e1lnu ot\u00e1zku z\u00edskavania odbornej sp\u00f4sobilosti na v\u00fdkon kontrolnej a riadiacej \u010dinnos\u0165 nad vykon\u00e1van\u00edm stavebn\u00fdch pr\u00e1c, nerie\u0161i celo\u017eivotn\u00e9 vzdel\u00e1vanie a\u00a0nerie\u0161i priamu osobn\u00fa zodpovednos\u0165 v\u0161etk\u00fdch os\u00f4b v\u00a0stavebnom a\u00a0administrat\u00edvnom procese stavebnej \u010dinnosti. Nekone\u010dn\u00e9 odvol\u00e1vanie sa na Z\u00e1kon \u010d.138\/92 o\u00a0autoriz\u00e1cii projektantov s\u00a0pou\u017eit\u00edm pre priame vykon\u00e1vanie a\u00a0kontrolu stavebnej \u010dinnosti na stavb\u00e1ch je pr\u00e1vny,\u00a0vecn\u00fd a v\u00a0skuto\u010dnosti protipr\u00e1vny pa\u0161kvil, preto\u017ee sa jedn\u00e1 o\u00a0viazan\u00fa podnikate\u013esk\u00fa \u010dinnos\u0165 v\u00a0zmysle z\u00e1kona \u010d.455\/91 Zb. v\u00a0aktu\u00e1lne platnom znen\u00ed v\u00a0s\u00fa\u010dinnosti so z\u00e1konom \u010d. 568\/2009 Z. z. o celo\u017eivotnom vzdel\u00e1van\u00ed. S\u00fadna prax jasne hovor\u00ed, \u017ee napr. stavebn\u00fd dozor je prakticky pr\u00e1vne nepostihnute\u013en\u00fd! V\u00a0stavebnej a\u00a0v\u00a0s\u00fadnej praxi n\u00e1s \u017eivot neust\u00e1le presvied\u010da, \u017ee pr\u00e1vne postihy chybuj\u00facich zodpovedn\u00fdch os\u00f4b v\u00a0stavebn\u00edctve s\u00fa prakticky neuskuto\u010dnite\u013en\u00e9 a\u00a0obe\u0165ami so st\u00e1tis\u00edcov\u00fdmi a\u017e mili\u00f3nov\u00fdmi \u0161kodami bez n\u00e1hrady sa st\u00e1vaj\u00fa investori stavieb.<\/p>\n<p>N\u00e1vrh z\u00e1kona tie\u017e jednozna\u010dne nerie\u0161i protispolo\u010densk\u00e9 konanie svojvo\u013enej v\u00fdstavby nepovolen\u00fdch stavieb, svojvo\u013en\u00fdch \u00faprav stavieb, sp\u00f4sob zamedzenia nepovolen\u00fdch stavieb, napriek hrozb\u00e1m vysok\u00fdch pok\u00fat. V\u00a0tejto \u010dasti je n\u00e1vrh z\u00e1kona pre verejnos\u0165 efektn\u00fd ale bezzub\u00fd! Poukazujeme na skuto\u010dnos\u0165, \u017ee v\u00fdstavba nepovolen\u00fdch stavieb je spolo\u010densk\u00fdm probl\u00e9mom a\u00a0probl\u00e9mom pre \u0161t\u00e1t v rozsahu sotva 1-2 % z\u00a0probl\u00e9mov cel\u00e9ho stavebn\u00edctva a\u00a0spolo\u010densk\u00e9ho \u017eivota ob\u010danov&#8230;<\/p>\n<p>Za s\u00fa\u010dasn\u00e9ho stavu vymo\u017eite\u013enosti pr\u00e1va a\u00a0postupn\u00e9ho pretrv\u00e1vaj\u00faceho \u00fapadku odbornosti a\u00a0mor\u00e1lky v\u00a0Slovenskom stavebn\u00edctve s\u00a0predpokladan\u00fdm progresom aj v\u00a0nasleduj\u00facom obdob\u00ed <strong>na\u0161a komora navrhuje a po\u017eaduje, vytvori\u0165 skuto\u010dne Nov\u00fd jednozna\u010dn\u00fd n\u00e1vrh \u201eStavebn\u00e9ho poriadku, Z\u00e1kona o\u00a0urbanizme, Z\u00e1kona o\u00a0\u00fazemnom pl\u00e1novan\u00ed\u201c s\u00a0presne definovan\u00fdmi a zrozumite\u013en\u00fdmi pojmami, pr\u00e1vami, povinnos\u0165ami<\/strong> <strong>a\u00a0osobnou zodpovednos\u0165ou<\/strong> tak, aby sa v\u00a0maxim\u00e1lne mo\u017enej miere obmedzila mo\u017enos\u0165 a kreativita \u201ein\u00e9ho pr\u00e1vneho n\u00e1zoru\u201c. Z\u00e1kon mus\u00ed ma\u0165 s\u00fa\u010dasne vlastnosti celospolo\u010denskej objedn\u00e1vky ma\u0165 vzdelan\u00fdch stavebn\u00fdch odborn\u00edkov, \u010d\u00edm vytvor\u00ed tlak na pr\u00edpravu ml\u00e1de\u017ee v\u00a0strednom a\u00a0vysokom \u0161kolstve.<\/p>\n<p>Nes\u00fahlas\u00edme s\u00a0t\u00fdm, aby sa tvorcovia a\u00a0predkladatelia n\u00e1vrhu z\u00e1kona neust\u00e1le odvol\u00e1vali na Eur\u00f3pske pr\u00edklady a\u00a0vzory zo \u0161t\u00e1tov s\u00a0\u010dasto in\u00fdmi trad\u00edciami, zvyklos\u0165ami a\u00a0sp\u00f4sobmi v stavebnej \u010dinnosti po\u00a0problematick\u00fdch prekladoch dokumentov zo \u0161t\u00e1tov EU do sloven\u010diny, d\u00fafaj\u00fac, \u017ee si to nikto neover\u00ed. Tvorcovia tento z\u00e1kon musia pripravi\u0165 pre Slovensk\u00e9 firmy a\u00a0pre Slovensk\u00fdch ob\u010danov so za\u017eit\u00fdm\u00a0tradi\u010dn\u00fdm syst\u00e9mom a\u00a0zvyklos\u0165ami v stavebnej \u010dinnosti na Slovensku.<\/p>\n<p>Z\u00e1verom kon\u0161tatujeme, \u017ee na z\u00e1klade len t\u00fdchto nieko\u013ek\u00fdch uveden\u00fdch pripomienok na\u0161a komora nes\u00fahlas\u00ed ani s\u00a0jedn\u00fdm z predlo\u017een\u00fdch n\u00e1vrhov z\u00e1konov, vr\u00e1tane\u00a0posledn\u00e9ho augustov\u00e9ho n\u00e1vrhu a\u00a0neodpor\u00fa\u010dame ich dopracovanie a schv\u00e1lenie. S\u00fabe\u017ene by sa vyhotovovali principi\u00e1lne naozaj nov\u00e9 syst\u00e9mov\u00e9 a\u00a0jasn\u00e9 z\u00e1kony\u00a0 o\u00a0urbanizme, \u00fazemnom pl\u00e1novan\u00ed a\u00a0stavebnom poriadku, pr\u00edpadne ich s\u00fabor ako jeden z\u00e1kon s\u00a0tromi \u010das\u0165ami.<\/p>\n<p><strong>S\u00fa\u010dasn\u00fd deformovan\u00fd legislat\u00edvny stav,\u00a0\u00fapadok profesijnej odbornosti a\u00a0vymo\u017eite\u013enosti pr\u00e1va si neodkladne vy\u017eaduje naozaj nov\u00fd syst\u00e9mov\u00fd koncep\u010dn\u00fd legislat\u00edvny poriadok aj pre oblas\u0165 stavebn\u00edctva, ale aj na pr\u00edpravu ml\u00e1de\u017ee pre stavebn\u00fa \u010dinnos\u0165 v\u00a0celom spektre stavebn\u00edctva.
