Stavebn\u00e9 \u00farady svoje rozhodnutie o nevyhoven\u00ed \u017eiadosti \u017eiadate\u013ea o vyhotovenie k\u00f3pi\u00ed z projektu stavby opieraj\u00fa o d\u00f4vod, \u017ee m\u00f4\u017ee d\u00f4js\u0165 k poru\u0161eniu nejak\u00e9ho z\u00e1kona a k zneu\u017eitiu alebo po\u0161kodeniu pr\u00e1v k du\u0161evn\u00e9mu vlastn\u00edctvu autora projektu, alebo autorsk\u00fdch pr\u00e1v autora projektu, preto z projektu neumo\u017enia vyhotovova\u0165 k\u00f3pie, ale umo\u017enia maxim\u00e1lne nahliadnutie&#8230;<\/p>\n<p><strong>Toto zd\u00f4vodnenie niektor\u00fdch stavebn\u00fdch \u00faradov nie je pr\u00e1vne ni\u010d\u00edm podlo\u017een\u00e9, preto\u017ee neexistuje \u017eiadna pr\u00e1vna \u00faprava, ktor\u00e1 by ukladala stavebn\u00fdm \u00faradom povinnos\u0165 chr\u00e1ni\u0165 niekoho pr\u00e1va k du\u0161evn\u00e9mu vlastn\u00edctvu, alebo autorsk\u00e9 pr\u00e1va!<\/strong><\/p>\n<p>Povinnos\u0165 ochrany tak\u00fdchto pr\u00e1v nevypl\u00fdva ani zo \u0161tat\u00fatu stavebn\u00e9ho \u00faradu, alebo mestsk\u00e9ho \u00faradu, neupravuje ich ani z\u00e1kon \u010d. 50\/1976 Zb. stavebn\u00fd z\u00e1kon, ani Z\u00e1kon NR SR \u010d. 222\/1996 Z. z. o organiz\u00e1cii miestnej \u0161t\u00e1tnej spr\u00e1vy a o zmene a doplnen\u00ed niektor\u00fdch z\u00e1konov, Z\u00e1kon \u010d. 302\/2001 Z. z. o samospr\u00e1ve vy\u0161\u0161\u00edch \u00fazemn\u00fdch celkov (z\u00e1kon o samospr\u00e1vnych krajoch), Z\u00e1kon \u010d. 180\/2013 Z. z. o organiz\u00e1cii miestnej \u0161t\u00e1tnej spr\u00e1vy a o zmene a doplnen\u00ed niektor\u00fdch z\u00e1konov, Z\u00e1kon SNR \u010d. 369\/1990 Zb. o obecnom zriaden\u00ed&#8230;<\/p>\n<p>Niektor\u00ed projektanti a niektor\u00e9 stavebn\u00e9 \u00farady maj\u00fa probl\u00e9m s rozl\u00ed\u0161en\u00edm, <strong>\u010do je du\u0161evn\u00e9 vlastn\u00edctvo<\/strong> a <strong>\u010do je autorsk\u00e9 pr\u00e1vo<\/strong> autora autorsk\u00e9ho diela.\u00a0 <strong>Du\u0161evn\u00e9 vlastn\u00edctvo<\/strong> upravuj\u00fa z\u00e1kony \u010d. <a class=\"NodeLink TT\" href=\"https:\/\/www.zakonypreludi.sk\/zz\/2001-435\">435\/2001 Z. z.<\/a> <span class=\"NodeName\" title=\"Patentov\u00fd z\u00e1kon\"> &#8211; z\u00e1konov!\u00a0<\/strong><br \/>\n<\/span><\/span><\/p>\n<p><strong>Projekt stavby a autorsk\u00e9 pr\u00e1va k projektu stavby, alebo k architektonick\u00e9mu dielu upravuje z\u00e1kon<\/strong> <strong>\u010d. 138\/1992 Zb. <\/strong><strong>autorizovan\u00fdch architektoch a autorizovan\u00fdch stavebn\u00fdch in\u017einieroch<\/strong> <strong>a z\u00e1kon \u010d. 185\/2015 Z.z. autorsk\u00fd z\u00e1kon. <\/strong><\/p>\n<p><strong>Z\u00e1kon \u010d. 138\/1992 Zb. a\u00a0 z\u00e1kon \u010d. 185\/2015 Z.z. nezakazuj\u00fa vyhotovova\u0165 k\u00f3pie z projektu, naopak z\u00e1kon \u010d. 185\/2015 Z.z. autorsk\u00fd z\u00e1kon, k\u00f3pie z projektu stavby umo\u017e\u0148uje vyhotovi\u0165, a to bez z\u00e1sahu do du\u0161evn\u00e9ho vlastn\u00edctva, resp. autorsk\u00e9ho pr\u00e1va&#8230;<\/strong><\/p>\n<p><strong>Na Slovensku nie je z\u00e1kon, ktor\u00fd znemo\u017e\u0148uje vyhotovova\u0165 k\u00f3pie z projektu stavby zvl\u00e1\u0161\u0165, ke\u010f \u017eiadate\u013e definuje pre ak\u00e9 \u00fa\u010dely k\u00f3pie projektu potrebuje. <\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Upozornenie:<\/strong><\/p>\n<p><strong>Z\u00e1kon \u010d. 185\/2015 Z.z.<\/strong> <strong>autorsk\u00fd z\u00e1kon, zakazuje vyhotovova\u0165 k\u00f3pie autorsk\u00e9ho diela bez s\u00fahlasu autora diela pre komer\u010dn\u00e9 \u00fa\u010dely, napr. pozme\u0148ovanie autorsk\u00e9ho diela a jeho n\u00e1sledn\u00fd predaj. <\/strong><\/p>\n<p>*<\/p>\n<p><strong>Upozornenie:<\/strong><\/p>\n<p><strong>Oprava, \u00fadr\u017eba alebo z\u00e1chrana architektonick\u00e9ho diela, alebo stavby, nie je z\u00e1sahom do pr\u00e1v autora projektu (\u00a756 z\u00e1k. 185\/2015 Z.z.) !<\/strong><\/p>\n<h3><span style=\"color: #000000;\">*<\/span><\/h3>\n<p><span style=\"color: #ff0000;\"><strong>Upozornenie:<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Toto vysvetlenie nie pou\u017eite\u013en\u00e9 pre pr\u00e1vne \u00fakony, je len informat\u00edvnou pom\u00f4ckou pre pr\u00e1vneho z\u00e1stupcu stavebn\u00edka, projektanta a stavebn\u00e9 \u00farady!
