Ka\u017ed\u00fa verziu z\u00e1kona n\u00e1m poslali na\u0161i sympatizanti s po\u017eiadavkou o n\u00e1zor, alebo aby sme ho vyu\u017eili ako uzn\u00e1me za vhodn\u00e9. To\u013eko na \u00favod.<\/p>\n<p>N\u00e1vrh z\u00e1kona v parlamente:<\/p>\n<p style=\"text-align: justify;\">Z\u00e1kon je syst\u00e9movo chaotick\u00fd, ustanovenia zo stavebn\u00e9ho poriadku s\u00fa vlo\u017een\u00e9 do \u00favodu pred \u00fazemn\u00e9 pl\u00e1novanie.Uvedieme v skratke niektor\u00e9 zo z\u00e1kladn\u00fdch probl\u00e9mov n\u00e1vrhu:<\/p>\n<p>\u00a7 12, 13 a 14 patria do stavebn\u00e9ho poriadku !<\/p>\n<p><strong>\u00a7 12 Nepovolen\u00e1 stavba<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong>(1) Nepovolenou stavbou je stavba uskuto\u010d\u0148ovan\u00e1 bez \u00fazemn\u00e9ho rozhodnutia alebo bez stavebn\u00e9ho povolenia, ak sa vy\u017eaduj\u00fa pod\u013ea tohto z\u00e1kona, a stavba uskuto\u010d\u0148ovan\u00e1 v\u00a0podstatnom rozpore s nimi. Podstatn\u00fdm rozporom sa rozumie tak\u00fd rozpor uskuto\u010d\u0148ovanej stavby so zastavovac\u00edmi podmienkami, ktor\u00fd vy\u017eaduje nov\u00e9 stavebn\u00e9 povolenie.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Ustanovenie je nejednozna\u010dn\u00e9 preto\u017ee d\u00e1va mo\u017enos\u0165 stava\u0165 bez stavebn\u00e9ho povolenia na z\u00e1klade \u00fazemn\u00e9ho rozhodnutia, preto\u017ee stavebn\u00e9 povolenie je dan\u00e9 ako variantn\u00e9 druhorad\u00e9 rie\u0161enie ako &#8222;alebo&#8220;. Ustanovenie d\u00e1va mo\u017enos\u0165 ob\u00eds\u0165 stavebn\u00e9 povolenie preto\u017ee posta\u010duje ma\u0165 v \u00fazemnom pl\u00e1ne lokalitu vy\u010dlenen\u00fa ako na v\u00fdstavbu&#8230; Druh\u00e1 veta toto len potvrdzuje preto\u017ee uprednost\u0148uje zastavovacie \u00fazemn\u00e9 podmienky, ktor\u00e9 patria do z\u00e1kona o \u00fazemnom pl\u00e1novan\u00ed&#8230;\u00a0 In\u00fdmi slovami som toho n\u00e1zoru, \u017ee ak pod\u013ea tohto ustanovenia postav\u00edte stavbu na \u00fazem\u00ed pre v\u00fdstavbu pod\u013ea \u00fazemn\u00e9ho rozhodnutia, nedopust\u00edte sa nepovolenej stavby a v\u0161eto ostatn\u00e9 je zbyto\u010dn\u00e9 rie\u0161i\u0165, sank\u010dne nie ste st\u00edhate\u013en\u00fd. Toto je vlastne stavebn\u00e9 povolenie alebo forma ohl\u00e1senia. (Zadn\u00e9 dvierka na \u010dierne stavby)<\/span><\/p>\n<p style=\"text-align: justify;\">(2) Stavba sa nepova\u017euje za nepovolen\u00fa, ak po\u010das jej uskuto\u010d\u0148ovania alebo kolaud\u00e1cie bolo \u00fazemn\u00e9 rozhodnutie alebo stavebn\u00e9 povolenie zru\u0161en\u00e9 spr\u00e1vnym org\u00e1nom v\u00a0r\u00e1mci prieskumu pr\u00e1voplatn\u00e9ho rozhodnutia alebo s\u00fadom v\u00a0spr\u00e1vnom s\u00fadnictve z\u00a0d\u00f4vodu, ktor\u00fd stavebn\u00edk nezavinil. O\u00a0takejto stavbe sa rozhodne v\u00a0novom konan\u00ed.<\/p>\n<p><strong>\u00a0\u00a7 13\u00a0 Neohl\u00e1sen\u00e1 stavba<\/strong><\/p>\n<p style=\"text-align: justify;\">(1) Neohl\u00e1senou stavbou je stavba uskuto\u010d\u0148ovan\u00e1 bez \u00fazemn\u00e9ho s\u00fahlasu alebo bez stavebn\u00e9ho s\u00fahlasu alebo v\u00a0podstatnom rozpore s\u00a0nimi. Podstatn\u00fdm rozporom sa rozumie tak\u00fd nes\u00falad uskuto\u010d\u0148ovanej stavby so zastavovac\u00edmi podmienkami, ktor\u00fd vy\u017eaduje nov\u00e9 ohl\u00e1senie alebo vy\u017eaduje \u00fazemn\u00e9 rozhodnutie alebo stavebn\u00e9 povolenie.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Ustanovenie je nejednozna\u010dn\u00e9 preto\u017ee d\u00e1va mo\u017enos\u0165 stava\u0165 bez ohl\u00e1senia na z\u00e1klade \u00fazemn\u00e9ho s\u00fahlasu (vi\u010f aj \u00a712 \u010do je v z\u00e1sade dtto), preto\u017ee stavebn\u00fd s\u00fahlas je dan\u00fd ako variantn\u00e9 druhorad\u00e9 rie\u0161enie ako &#8222;alebo&#8220;. Ustanovenie d\u00e1va mo\u017enos\u0165 ob\u00eds\u0165 ohl\u00e1senie preto\u017ee posta\u010duje ma\u0165 v \u00fazemnom pl\u00e1ne lokalitu vy\u010dlenen\u00fa na v\u00fdstavbu a vybavi\u0165 si \u00fazemn\u00fd s\u00fahlas \u010do nebude probl\u00e9m ak je \u00fazemie pripravovan\u00e9 na z\u00e1stavbu&#8230; Druh\u00e1 veta toto len potvrdzuje preto\u017ee uprednost\u0148uje zastavovacie \u00fazemn\u00e9 podmienky, ktor\u00e9 patria do z\u00e1kona o \u00fazemnom pl\u00e1novan\u00ed&#8230;\u00a0 In\u00fdmi slovami som toho n\u00e1zoru, \u017ee ak pod\u013ea tohto ustanovenia postav\u00edte stavbu na \u00fazem\u00ed pripravovanom alebo u\u017e ur\u010denom pre v\u00fdstavbu pod\u013ea \u00fazemn\u00e9hos\u00fahlasu , nedopust\u00edte sa nepovolenej stavby a v\u0161eto ostatn\u00e9 je zbyto\u010dn\u00e9 rie\u0161i\u0165, sank\u010dne nie ste st\u00edhate\u013en\u00fd.<\/span><\/p>\n<p>(2) \u00dazemn\u00fdm s\u00fahlasom sa rozumie p\u00edsomn\u00e9 ozn\u00e1menie obce, \u017ee s\u00fahlas\u00ed so\u00a0zmenou vyu\u017e\u00edvania pozemkov pod\u013ea ohl\u00e1senia.<\/p>\n<p><span style=\"color: #0000ff;\">Toto je vlastne stavebn\u00e9 povolenie alebo forma ohl\u00e1senia. Probl\u00e9mom je nesyst\u00e9mov\u00e1 legislat\u00edva pre v\u00fdstavbu zdeformovan\u00e1 neskuto\u010dn\u00fdm mno\u017estvom nesyst\u00e9mov\u00fdch zmien po\u010das v\u0161etk\u00fdch doteraj\u0161\u00edch vl\u00e1d &#8211; V\u0160ETK\u00ddCH !! \u00a0<\/span><\/p>\n<p><strong>\u010eal\u0161\u00ed probl\u00e9m je pyram\u00eddov\u00fd syst\u00e9m dod\u00e1vate\u013esko odberate\u013esk\u00fdch vz\u0165ahov, vys\u00fa\u0165a\u017eenie z\u00e1kazky firmou, ktor\u00e1 ani nem\u00e1 zamestnan\u00fdch stavb\u00e1rov ale len pr\u00e1vnikov, ekon\u00f3mov a obchodn\u00edkov. Je nejasn\u00e1 a\u017e ch\u00fdbaj\u00faca zodpovednos\u0165 za stavebn\u00e9 dielo, anarchia v oce\u0148ovan\u00ed v\u0161etk\u00fdch stavebn\u00fdch \u010dinnostiach od cien za projekt cez stavebn\u00e9 pr\u00e1ce, materi\u00e1ly a\u017e po riadiacich a kontroln\u00fdch pracovn\u00edkov a aj tento n\u00e1vrh z\u00e1kona ktor\u00fd vych\u00e1dza zo stiahnut\u00e9ho z\u00e1kona z roku 2006 aj ke\u010f pomie\u0161ali \u010dasti stavebn\u00e9ho poriadku do \u00favodu a uzemn\u00e9 pl\u00e1novanie nadradili nad stavebn\u00e9 konanie a takto to vlastne cel\u00e9 zmie\u0161ali aj s \u00fazemnu\u00fdm pl\u00e1novan\u00edm a so \u0161kolsk\u00fdmi defin\u00edciami na \u00farovni stavebn\u00e9ho odborn\u00e9ho u\u010dili\u0161\u0165a. <\/strong><\/p>\n<p><span style=\"color: #0000ff;\">Toto je len v\u00fdber z mno\u017estva probl\u00e9mov\u00fdch ustanoven\u00ed z\u00e1kona, nech sa s t\u00fdm u\u017e poslanci potr\u00e1pia.
