V\u0161etci to vedia, v\u0161etci s t\u00fdm s\u00fahlasia, ale u\u017e 15 rokov s t\u00fdm nikto ni\u010d nevie urobi\u0165. Nap\u00edsan\u00e9 z\u00e1kony skon\u010dia v ko\u0161i a\u00a0tr\u00e1penie pokra\u010duje.<\/p>\n<p>&nbsp;<\/p>\n<p>Prezident Stavebnej komory SR Ivan Pauer predch\u00e1dzaj\u00face dva roky pom\u00e1hal s pr\u00edpravou nov\u00e9ho stavebn\u00e9ho pr\u00e1va. Ministerstvo dopravy pod veden\u00edm \u00c1rp\u00e1da \u00c9rseka (Most-H\u00edd) malo z\u00e1kony aj hotov\u00e9, ale napokon ich u\u017e nepredlo\u017eilo do parlamentu. Prek\u00e1\u017ekou bolo pod\u013ea Pauera pr\u00edli\u0161 ve\u013ea \u013eud\u00ed v poradnej komisii, z ktor\u00fdch mnoh\u00ed nemali sk\u00fasenosti.<\/p>\n<p>&nbsp;<\/p>\n<p>Teraz chyst\u00e1 zmenu stavebn\u00e9ho z\u00e1kona vicepremi\u00e9r pre legislat\u00edvu \u0160tefan Hol\u00fd (Sme rodina), ktor\u00fd si u\u017e stavebn\u00fa komoru na pomoc nevolal.<\/p>\n<p>&nbsp;<\/p>\n<p>Pauer v e-mailovom rozhovore k nov\u00e9mu z\u00e1konu vysvet\u013euje:<\/p>\n<ol>\n<li>pre\u010do je presunutie stavebn\u00fdch \u00faradov z obc\u00ed na \u0161t\u00e1t dobr\u00fd n\u00e1pad;<\/li>\n<li>kedy je \u00fazemn\u00e9 konanie zbyto\u010dn\u00e9 a pre\u010do je lep\u0161ie ma\u0165 rad\u0161ej poriadne \u00fazemn\u00e9 pl\u00e1ny;<\/li>\n<li>\u017ee rizikom z\u00e1kona o v\u00fdstavbe z poh\u013eadu korupcie je poz\u00edcia takzvan\u00e9ho licencovan\u00e9ho projektanta, ktor\u00fd m\u00e1 pri niektor\u00fdch stavb\u00e1ch fakticky prevzia\u0165 \u00falohu stavebn\u00e9ho \u00faradu;<\/li>\n<li>pre\u010do s\u00fa probl\u00e9m lobisti a pr\u00edli\u0161 ve\u013ek\u00e9 mno\u017estvo pripomienok.<\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u010co si mysl\u00edte o novom stavebnom z\u00e1kone?<\/strong><\/p>\n<p>Ni\u010d, preto\u017ee na\u0161a komora napriek pr\u00eds\u013eubu \u0160tefana Hol\u00e9ho nebola na jeho pr\u00edpravu pozvan\u00e1. Z\u00e1kladn\u00e9 podklady princ\u00edpov, ako tvori\u0165 tento z\u00e1kon, si od n\u00e1s vicepremi\u00e9r pre legislat\u00edvu s po\u010fakovan\u00edm prevzal a viac na n\u00e1s nemal \u010das.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Je spr\u00e1vnym rie\u0161en\u00edm zru\u0161i\u0165 \u00fazemn\u00e9 konanie?<\/strong><\/p>\n<p>Tu si mus\u00edme veci spresni\u0165 a rozdeli\u0165. \u00dazemn\u00fd pl\u00e1n by mal by\u0165 schv\u00e1len\u00fd \u00fazemn\u00fdm konan\u00edm v obci \u010di v meste na z\u00e1klade ods\u00fahlasen\u00e9ho urbanistick\u00e9ho pl\u00e1nu. Pod\u013ea toho m\u00e1 potom obec schv\u00e1len\u00e9 v\u0161eobecne z\u00e1v\u00e4zn\u00e9 nariadenia (VZN), ktor\u00e9 sa zoh\u013ead\u0148uj\u00fa v procese povo\u013eovania stavieb. Ak je schva\u013eovan\u00e1 stavba navrhnut\u00e1 v s\u00falade s platn\u00fdm \u00fazemn\u00fdm pl\u00e1nom a VZN, \u010fal\u0161ie \u00fazemn\u00e9 konanie je duplicitn\u00e9 a zbyto\u010dn\u00e9. Ak sa v\u0161ak stavba v nie\u010dom odli\u0161uje od \u00fazemn\u00e9ho pl\u00e1nu, VZN a urbanistick\u00e9ho pl\u00e1nu, \u00fazemn\u00e9 konanie na t\u00fato stavbu je potrebn\u00e9.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Daj\u00fa sa \u00fazemn\u00e9 pl\u00e1ny obc\u00ed a z\u00f3n vypracova\u0165 tak podrobne a nepriestrelne, <\/strong><strong>\u017ee m\u00f4\u017eu v princ\u00edpe suplova\u0165 zmysel a \u00falohu \u00fazemn\u00e9ho konania?<\/strong><\/p>\n<p>Ak \u0161t\u00e1t, kraj, okres, mesto a obec vedia, ako chc\u00fa rozv\u00edja\u0165 svoje \u00fazemie, nem\u00f4\u017ee by\u0165 probl\u00e9m vyhotovi\u0165 komplexn\u00fd urbanistick\u00fd pl\u00e1n rozvoja miest a obc\u00ed v s\u00falade s rozvojom \u0161t\u00e1tu. Potom u\u017e nem\u00f4\u017ee by\u0165 probl\u00e9m vyhotovi\u0165 konkr\u00e9tne, presn\u00e9 a dlhodobo platn\u00e9 \u00fazemn\u00e9 pl\u00e1ny. Toto je doposia\u013e na Slovensku pre politick\u00fa nev\u00f4\u013eu nemo\u017en\u00e9, napriek tomu, \u017ee mnoh\u00e9 vyspel\u00e9 \u0161t\u00e1ty sveta, a dokonca u\u017e aj v Afrike tento syst\u00e9m aplikuj\u00fa.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u010co s\u00fa najd\u00f4le\u017eitej\u0161ie a naj\u0165a\u017e\u0161ie \u00falohy obc\u00ed v oblasti \u00fazemn\u00e9ho <\/strong><strong>pl\u00e1novania?<\/strong><\/p>\n<p>Hlavn\u00fdm probl\u00e9mom miest a obc\u00ed je, \u017ee nevedia, \u010do chc\u00fa, ale chc\u00fa to. Mnoh\u00e9 mest\u00e1 a obce nevedia, ak\u00fdm smerom budova\u0165 svoj charakter mesta a jeho rozvoj. Preto nie je vz\u00e1cnos\u0165ou, \u017ee sa ka\u017ed\u00fa chv\u00ed\u013eu menia \u00fazemn\u00e9 pl\u00e1ny a z\u00e1kony. V\u0161etko sa rob\u00ed ad hoc, kto kedy ako potrebuje. Druhou \u010das\u0165ou odpovede je nedostatok nov\u00fdch kvalitn\u00fdch odborn\u00edkov s praktick\u00fdmi sk\u00fasenos\u0165ami pre urbanizmus a \u00fazemn\u00e9 pl\u00e1novanie, ktor\u00ed poznaj\u00fa miestne danosti, podmienky pre rozvoj, kult\u00faru, trad\u00edcie.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>S\u00fahlas\u00edte s t\u00fdm, \u017ee stavebn\u00e9 konania by sa mali presun\u00fa\u0165 na \u0161t\u00e1t a\u00a0\u00fazemn\u00e9 pl\u00e1novanie m\u00e1 zosta\u0165 v ruk\u00e1ch obc\u00ed?<\/strong><\/p>\n<p>\u00c1no. Je to aj s\u00fa\u010das\u0165ou n\u00e1\u0161ho alternat\u00edvneho stavebn\u00e9ho z\u00e1kona z roku 2012, ktor\u00fd vypracovala Slovensk\u00e1 asoci\u00e1cia stavebn\u00fdch dozorov a\u00a0odborne sp\u00f4sobil\u00fdch os\u00f4b (SASDARS) a ktor\u00fd bol prerokovan\u00fd s poradcami vtedaj\u0161ieho premi\u00e9ra na \u00farade vl\u00e1dy, ale pre revolu\u010dnos\u0165 nebol prijat\u00fd.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Pre\u010do je dobr\u00e9 stavebn\u00e9 konania centralizova\u0165?<\/strong><\/p>\n<p>Preto\u017ee sa mus\u00ed skon\u010di\u0165 s anarchiou v riaden\u00ed. Bez zjednotenia koncepcie rozvoja obytn\u00fdch s\u00eddiel a zavedenia riadiaceho syst\u00e9mu to inak ani nejde. Preto s\u00fa vyspel\u00e9 \u0161t\u00e1ty vyspel\u00fdmi \u0161t\u00e1tmi, preto sa kedysi bankrotuj\u00face chudobn\u00e9 \u0161t\u00e1ty stali hospod\u00e1rskymi tigrami, a t\u00ed, ktor\u00ed tento syst\u00e9m opustili, sa rozpadaj\u00fa a chudobnej\u00fa.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u010co hovor\u00edte na my\u0161lienku, \u017ee rolu stavebn\u00e9ho \u00faradu m\u00e1 pri rodinn\u00fdch domoch a in\u00fdch jednoduch\u00fdch stavb\u00e1ch fakticky prebra\u0165 licencovan\u00fd projektant?<\/strong><\/p>\n<p>Nielen ja to pova\u017eujem za administrat\u00edvny a pr\u00e1vny nezmyseln\u00fd experiment, ktor\u00fd m\u00f4\u017ee celkom re\u00e1lne vytvori\u0165 priestor na bujnenie klientelizmu. Ale hlavne to bude ma\u0165 s vysokou pravdepodobnos\u0165ou a\u017e s istotou negat\u00edvny vplyv na v\u00fdstavbu v obciach, susedsk\u00e9 vz\u0165ahy, ale najm\u00e4 na vymo\u017eite\u013enos\u0165 pr\u00e1va a n\u00e1hradu \u0161k\u00f4d, ktor\u00e9 to re\u00e1lne m\u00f4\u017ee sp\u00f4sobi\u0165.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Funguje tak\u00fdto model aj inde v zahrani\u010d\u00ed? Ak\u00e9 s\u00fa s t\u00fdm sk\u00fasenosti a ak\u00e9 s\u00fa rizik\u00e1?<\/strong><\/p>\n<p>Nie\u010do podobn\u00e9 existovalo do prvej polovice 60. rokov minul\u00e9ho storo\u010dia a\u00a0za prvej republiky \u010di Rak\u00fasko-Uhorska. Pri tvorbe posledn\u00e9ho \u010desk\u00e9ho z\u00e1kona boli tie\u017e tak\u00e9to n\u00e1vrhy, ale boli aj r\u00fdchlo zavrhnut\u00e9. Akademicky: osobne by som si vedel predstavi\u0165 tak\u00e9ho projektanta, ktor\u00fd v s\u00falade s platn\u00fdm \u00fazemn\u00fdm pl\u00e1nom a VZN za pr\u00edsnych pravidiel vie spravi\u0165 projekt pre rodinn\u00fd dom alebo gar\u00e1\u017e a d\u00e1 k nemu vyjadrenie, \u017ee sp\u013a\u0148a v\u0161etky podmienky pre umiestnenie stavby, a tak\u00e9 vyjadrenie odovzd\u00e1 obci ako napr\u00edklad vyjadrenie k vykonaniu stavby.<\/p>\n<p>Tak\u00fdto projektant by v podstate mohol by\u0165 aj ka\u017ed\u00fd autorizovan\u00fd projektant, respekt\u00edve architekt, ale vzh\u013eadom na to, \u017ee ide aj o \u00faradn\u00fd akt, musia by\u0165 stabilizovan\u00e9 pr\u00edsne obmedzuj\u00face pr\u00e1va tak\u00e9hoto aktu, povinnosti a\u00a0majetkov\u00e1 a trestn\u00e1 zodpovednos\u0165 projektanta. Mus\u00ed by\u0165 s\u00fa\u010dasne zabezpe\u010den\u00e1 pr\u00edsna kontrola takejto \u010dinnosti zo strany \u0161t\u00e1tu, nie pr\u00edslu\u0161nou obcou, v ktorej \u010dinnos\u0165 vykon\u00e1va.<\/p>\n<p>&nbsp;<\/p>\n<p>Tak\u017ee, kto bude tak\u00e9ho \u010dloveka kontrolova\u0165, ke\u010f nevieme kontrolova\u0165 u\u017e ani samotn\u00fa v\u00fdstavbu, neexistuje kontrola projektov a mnoh\u00fdch \u010fal\u0161\u00edch \u010dinnost\u00ed? Nerobme si il\u00fazie, sme na Slovensku a vieme, ako sa niektor\u00ed jednotlivci s pe\u010diatkou v ruke vedia spr\u00e1va\u0165, ke\u010f sa im d\u00e1 mo\u017enos\u0165.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Podie\u013eali ste sa na tvorbe oboch z\u00e1konov \u2013 o v\u00fdstavbe a o\u00a0\u00fazemnom pl\u00e1novan\u00ed v rokoch 2018 \u2013 2020. Vtedaj\u0161\u00ed minister dopravy \u00c9rsek hovoril, \u017ee maj\u00fa by\u0165 \u00fa\u010dinn\u00e9 od roku 2020. Pre\u010do sa tak nestalo?<\/strong><\/p>\n<p>\u010co sa t\u00fdka z\u00e1kona o \u00fazemnom pl\u00e1novan\u00ed, ten bol v z\u00e1sade napriek niektor\u00fdm nedotiahnut\u00fdm kompromisom prijate\u013en\u00fd a v praxi pou\u017eite\u013en\u00fd. \u010co sa t\u00fdka z\u00e1kona o v\u00fdstavbe, boli tam viacer\u00e9 slovn\u00e9 novotvary, \u010do s praxou na stavb\u00e1ch nemalo ni\u010d spolo\u010dn\u00e9, prive\u013ea pr\u00e1vnych k\u013eu\u010diek, ako napr\u00edklad sankcionova\u0165 \u010diernu stavbu, ale kdesi vzadu v z\u00e1kone bolo, ako ju nesankcionova\u0165. Ak sa dobre pam\u00e4t\u00e1m, na\u0161a komora dala asi 150 pripomienok, ktor\u00e9 sa lobistom a niekomu z tvorcov nep\u00e1\u010dili. Celkom bolo vy\u0161e 3000 pripomienok, a\u00a0to z\u00e1sadn\u00fdch. Z\u00e1kon sa pri tom po\u010dte pripomienok jednoducho nedal upravi\u0165, tak ako v\u0161etky predch\u00e1dzaj\u00face od roku 2006.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u010co boli najv\u00e4\u010d\u0161ie slabiny t\u00fdchto z\u00e1konov a pre\u010do sa neodstr\u00e1nili?<\/strong><\/p>\n<p>Probl\u00e9m bol hlavne vo ve\u013emi ve\u013ekej skupine \u013eud\u00ed, ktor\u00ed boli v\u00a0konzulta\u010dnej skupine. A m\u00e1m tie\u017e podozrenie, \u017ee hlavne pri z\u00e1kone o v\u00fdstavbe sa uplatnili \u0161tudenti a \u013eudia, ktor\u00ed nemali dlhoro\u010dn\u00fa re\u00e1lnu prax v ter\u00e9ne, ale kdesi na \u0161kole \u010di v \u00farade. Dovol\u00edm si pripomen\u00fa\u0165 slov\u00e1 Cyrila Northcote Parkinsona o\u00a0tvorbe z\u00e1konov: ak vl\u00e1da \u017eiada, aby ministerstvo vyhotovilo z\u00e1kon k jej probl\u00e9mu, ale ministerstvo ho nechce, tak vytvor\u00ed 51-\u010dlenn\u00fa komisiu odborn\u00edkov z\u00a0rozli\u010dn\u00fdch odborov a z\u00e1ujmov, ktor\u00ed sa bud\u00fa dva roky nekone\u010dne sch\u00e1dza\u0165 a h\u00e1da\u0165, a potom predlo\u017eia z\u00e1kon, ktor\u00fd je nepou\u017eite\u013en\u00fd alebo u\u017e nie je potrebn\u00fd, preto\u017ee probl\u00e9m sa vyrie\u0161il aj s\u00e1m. Ak ministerstvo potrebuje naozaj \u00fa\u010dinn\u00fd a kvalitn\u00fd z\u00e1kon, vytvor\u00ed mal\u00fa 5-\u010dlenn\u00fa skupinu skuto\u010dn\u00fdch odborn\u00edkov a z\u00e1kon za p\u00e1r mesiacov snemov\u0148a schva\u013euje.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Je naozaj na Slovensku d\u013a\u017eka povo\u013eovac\u00edch procesov tak\u00e1 problematick\u00e1 v porovnan\u00ed s t\u00fdm, \u010do je be\u017en\u00e9 v Eur\u00f3pe?<\/strong><\/p>\n<p>Je a je to sp\u00f4soben\u00e9 nekone\u010dn\u00fdmi ad hoc novelami pod\u013ea potrieb aktu\u00e1lnej vl\u00e1dy a pod\u013ea potrieb telefon\u00e1tu strategick\u00e9ho investora. Ale hlavn\u00fd probl\u00e9m je, \u017ee na Slovensku u\u017e pomaly niet z\u00e1kona, ktor\u00fd je zmysluplne previazan\u00fd na in\u00fd dotknut\u00fd z\u00e1kon a v stavebn\u00edctve t\u00fato situ\u00e1ciu vid\u00edm ako najhor\u0161iu.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Viete to porovna\u0165 napr\u00edklad s \u010ceskou republikou, Rak\u00faskom alebo Ma\u010farskom?<\/strong><\/p>\n<p>O tak\u00fdch probl\u00e9moch ako na Slovensku, som v Rak\u00fasku a vo \u0160vaj\u010diarsku nepo\u010dul. Z\u00e1kony si tam nerozb\u00edjaj\u00fa ako my a z\u00e1sady pravidiel v\u00fdstavby takmer nemenia, s\u00fa stabiln\u00e9. V \u010cesku maj\u00fa podobn\u00e9 probl\u00e9my ako aj my, napriek tomu, \u017ee u\u017e mnoh\u00e9 zlep\u0161ili. Ma\u010farsko m\u00e1 in\u00fd syst\u00e9m povo\u013eovania stavieb ako u n\u00e1s, ale tam ve\u013emi pokro\u010dili v odb\u00faravan\u00ed byrokracie v tejto oblasti.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u010co robia in\u00e9 krajiny lep\u0161ie?<\/strong><\/p>\n<p>Viac si str\u00e1\u017eia lobistov v legislat\u00edve, administrat\u00edvu rozvojom informa\u010dn\u00fdch syst\u00e9mov sk\u00f4r zni\u017euj\u00fa, dr\u017eia sa urbanizmu, teda koncep\u010dn\u00e9ho rozvoja obytn\u00fdch s\u00eddiel, a hlavne ka\u017ed\u00fd pozn\u00e1 svoje pr\u00e1va, povinnosti a zodpovednos\u0165 na stavbe a na \u00faradoch.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Ako dlho toto tr\u00e1penie so stavebn\u00fdm z\u00e1konom u\u017e trv\u00e1?<\/strong><\/p>\n<p>Ak hovor\u00edme o tvorbe nov\u00e9ho stavebn\u00e9ho z\u00e1kona, tak od jeho prvej verzie z roku 2006 za Dzurindovej vl\u00e1dy. Ficova vl\u00e1da mala najbli\u017e\u0161ie k\u00a0vytvoreniu nov\u00e9ho z\u00e1kona, ale prevl\u00e1daj\u00fa a\u017e doposia\u013e obchodn\u00e9 z\u00e1ujmy jedincov, lobistov a politick\u00fdch str\u00e1n a nie z\u00e1ujmy \u0161t\u00e1tu, teda ob\u010danov, ktor\u00ed ich \u017eivia.
