tohto nov\u00e9ho z\u00e1kona \u010d. 201\/2022 Z.z. o v\u00fdstavbe v s\u00favislosti s pr\u00edpravou a uskuto\u010d\u0148ovan\u00edm stavieb (\u010des\u0165 nieko\u013ek\u00fdm m\u00e1lo u\u017eito\u010dn\u00fdm ustanoveniam), ktor\u00fd bol podobne, ako v \u010ceskej republike nar\u00fdchlo pozliepan\u00fd bez akceptovania niektor\u00fdch n\u00e1vrhov \u00fa\u010dastn\u00edkov pr\u00edpravy z\u00e1kona a verejnosti, a ktor\u00fd bol uveden\u00fd un\u00e1hlene bez pripravenej technickej a administrat\u00edvnej odpory a bez vykon\u00e1vac\u00edch predpisov, ktor\u00e9 e\u0161te len teraz za\u010d\u00ednaj\u00fa na slovensku pripravova\u0165.<\/div>\n<\/div>\n<div class=\"x11i5rnm xat24cr x1mh8g0r x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"color: #ffffff;\">&#8211;<\/span><\/div>\n<div dir=\"auto\">Len na okraj, \u010desk\u00fd z\u00e1kon \u010dak\u00e1 u\u017e tretia ve\u013ek\u00e1 noveliz\u00e1cia a Slovensk\u00fd prv\u00e1, alebo celkom nov\u00fd z\u00e1kon&#8230;<\/div>\n<\/div>\n<div class=\"x11i5rnm xat24cr x1mh8g0r x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Taktie\u017e pr\u00edtomn\u00ed s\u00fahlasili s mojim n\u00e1zorom, \u017ee v z\u00e1kone ch\u00fdba po\u017eiadavka a tlak na odbornos\u0165 vo v\u00fdstavbe na v\u0161etk\u00fdch \u00farovniach pr\u00edpravy a v\u00fdstavby po\u010dn\u00fac remeseln\u00edkmi, kvalitn\u00e1 pr\u00edprava v \u0161kol\u00e1ch a potreba skuto\u010dn\u00e9ho celo\u017eivotn\u00e9ho vzdel\u00e1vania tie\u017e na v\u0161etk\u00fdch \u00farovniach&#8230;.<\/div>\n<\/div>\n<div class=\"x11i5rnm xat24cr x1mh8g0r x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"color: #ffffff;\">&#8211;<\/span><\/div>\n<div dir=\"auto\">Okrem in\u00e9ho pr\u00edtomn\u00ed s\u00fahlasili aj s n\u00e1zorom, \u017ee v bytov\u00fdch domoch sa nemaj\u00fa robi\u0165 \u017eiadne stavebn\u00e9 zmeny okrem \u00fadr\u017eby stavieb &#8211; budov.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div dir=\"auto\">\n<p>Tie\u017e sme pouk\u00e1zali na zauj\u00edmav\u00fd fakt, \u017ee z\u00e1kon nadobudol platnos\u0165 7.6.2022, ale \u00fa\u010dinnos\u0165 a\u017e 1.4.2024, t. j. po skon\u010den\u00ed p\u00f4sobenia tejto aktu\u00e1lnej vl\u00e1dy ktor\u00e1 ho ponechala, ako v\u00fdbu\u0161n\u00fd dar\u010dek novej bud\u00facej vl\u00e1de, preto\u017ee u\u017e dnes mnoh\u00ed odborn\u00edci v kulo\u00e1roch hovoria o zmene z\u00e1kona a tie\u017e o \u00faplne novom z\u00e1kone podobne, ako sa to deje v \u010ceskej republike, kde chystaj\u00fa u\u017e tretiu zmenu od jeho ned\u00e1vneho zavedenia&#8230;<\/p>\n<p>Nov\u00fd \u010cesk\u00fd tak aj Slovensk\u00fd stavebn\u00fd z\u00e1kon\u00a0 je v mnoh\u00fdch pr\u00edpadoch tie\u017e komplikovan\u00fd, nejasn\u00fd a nedorie\u0161en\u00fd, len preto, aby sa splnila politick\u00e1 agenda aktu\u00e1lnych politikov, ktor\u00ed jeho tvorbu najprv zd\u00f4vod\u0148ovali bojom proti \u010diernym stavb\u00e1m, potom potrebou zjednodu\u0161i\u0165 stavebn\u00e9 konanie a naposledy skr\u00e1ti\u0165 lehoty vydania stavebn\u00fdch povolen\u00ed digitaliz\u00e1ciou, aby sa mohla spusti\u0165 pripraven\u00e1 hromadn\u00e1 v\u00fdstavba n\u00e1jomn\u00fdch domov.<\/p>\n<p>Uk\u00e1zalo sa, \u017ee ani jedno ani druh\u00e9 nebola a nie je pravda, preto\u017ee z\u00e1kon je nepripraven\u00fd na jeho uvedenie do \u017eivota a pripraven\u00ed s\u00fa len nedo\u010dkav\u00ed zahrani\u010dn\u00ed investori a ich stavebn\u00e9 firmy&#8230;<\/p>\n<p>Na spustenie hromadnej v\u00fdstavby posta\u010dovala n\u00e1sledne &#8211; ex post vykonan\u00e1 novela z\u00e1kona \u010d. 443\/2010 Z.z., ktor\u00e1 bola publikovan\u00e1, ako z\u00e1kon \u010d. 358\/2020 Z. z. o dot\u00e1ci\u00e1ch na rozvoj b\u00fdvania a o soci\u00e1lnom b\u00fdvan\u00ed v znen\u00ed. P\u00f4vodn\u00fd z\u00e1kon \u010d. 50\/1976 Zb. sta\u010dilo o\u010disti\u0165 od desiatok \u010dasto protire\u010div\u00fdch \u00fa\u010delov\u00fdch zmien, aktualizova\u0165 nieko\u013eko m\u00e1lo ustanoven\u00ed, vyda\u0165 3-4 zmyslupln\u00e9 vykon\u00e1vacie predpisy vyhl\u00e1\u0161kou a zru\u0161i\u0165 ustanovenia t\u00fdkaj\u00face sa stavebn\u00e9ho poriadku nezmyselne aplikovan\u00fdch v in\u00fdch z\u00e1konoch, napr. aj v z\u00e1kone o \u017eivotnom prostred\u00ed&#8230;<\/p>\n<p>Znenie z\u00e1kona sk\u00f4r nazna\u010duje u\u013eah\u010denie v\u00fdstavby pre dom\u00e1cich a zahrani\u010dn\u00fdch developerov a stavebn\u00e9 firmy, kde a ako sa bude da\u0165, napriek nieko\u013ek\u00fdm dobre znej\u00facim ustanoveniam v z\u00e1kone.
