Stavebn\u00fd z\u00e1kon a \u017ee kv\u00f4li tomu nebolo potrebn\u00e9 robi\u0165 tzv. nov\u00fd ale nie ve\u013emi podaren\u00fd z\u00e1kon \u010d. 201\/2022 Z.z., ako n\u00e1m to tzv. politici v m\u00e9di\u00e1ch tla\u010dili do hl\u00e1v&#8230; Plnenie a neplnenie ka\u017ed\u00e9ho z\u00e1kona z\u00e1vis\u00ed len na schopnostiach a osobnej odvahe a svedom\u00ed \u00faradn\u00edkov stavebn\u00e9ho \u00faradu, ale nie len t\u00fdchto \u00faradov.<\/div>\n<div dir=\"auto\"><\/div>\n<\/div>\n<div class=\"x11i5rnm xat24cr x1mh8g0r x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">Ide o ve\u013emi zauj\u00edmav\u00fd pr\u00edpad nepovolenej stavby v Bardejove, ktor\u00fd bude svojim sp\u00f4sobom precedens na Slovensku. S\u00fa jednoducho situ\u00e1cie, kedy nepom\u00f4\u017ee by\u0165 ani vrcholov\u00fdm \u0161portovcom, nepom\u00f4\u017eu ani zn\u00e1mosti a ani r\u00f4zne formy v\u010fa\u010dnosti&#8230;<\/div>\n<\/div>\n<div class=\"x11i5rnm xat24cr x1mh8g0r x1vvkbs xtlvy1s x126k92a\">\n<div dir=\"auto\">Obzvl\u00e1\u0161\u0165 je tento pr\u00edpad zauj\u00edmav\u00fd dlhou t\u0155nistou cestou boja za pr\u00e1va oby\u010dajn\u00fdch \u013eud\u00ed bez ak\u00e9hoko\u013evek stup\u0148a finan\u010dn\u00e9ho, spolo\u010densk\u00e9ho a mocensk\u00e9ho vplyvu, len cestou z\u00e1konov tohto \u0161t\u00e1tu! Je len na \u00faradn\u00edkoch \u010di oni sami z\u00e1kony poznaj\u00fa, \u010di ich vedia aplikova\u0165, alebo bud\u00fa bezhrani\u010dne posl\u00facha\u0165 \u017eelania svojich priate\u013eov a nadriaden\u00fdch, aby nekonali v s\u00falade so z\u00e1konom, veci na\u0165ahovali do nekone\u010dna, zatv\u00e1rali o\u010di nad poru\u0161ovan\u00edm z\u00e1konov a tak \u010di tak riskovali svoju kari\u00e9ru, dobr\u00fa poves\u0165 a &#8222;\u010dist\u00e9 meno&#8220; len za to, aby vyhoveli nadriaden\u00fdm a t\u00ed ich nevyhodili z pr\u00e1ce&#8230; No na druhej strane, ak vyhovej\u00fa \u017eelaniu \u0161\u00e9fa alebo priate\u013ea, ktor\u00e9 je za hranicou z\u00e1konnosti a bude z toho probl\u00e9m, bud\u00fa aj tak hoden\u00ed cez palubu, ale na ulicu&#8230;..<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<p><span class=\"style-scope yt-formatted-string\" dir=\"auto\">\u017dia\u013e podobn\u00fdch pr\u00edpadov na Slovensku je viac. <\/span> <span class=\"style-scope yt-formatted-string\" dir=\"auto\">Len na\u0161a Stavebn\u00e1 komora od roku 2018 pom\u00e1hala rie\u0161i\u0165 4 pr\u00edpady &#8222;\u010diernych stavieb&#8220; na \u017eiados\u0165 advok\u00e1tskych kancel\u00e1ri\u00ed a jeden na \u017eiados\u0165 samotn\u00e9ho stavebn\u00e9ho \u00faradu. 2+tento tret\u00ed pr\u00edpad boli &#8222;\u010dierne stavby&#8220; vinou nespr\u00e1vneho rozhodnutia stavebn\u00e9ho \u00faradu&#8230; <\/span><\/p>\n<p><span class=\"style-scope yt-formatted-string\" dir=\"auto\">Aktu\u00e1lne rie\u0161ime \u010fal\u0161ie dva extr\u00e9mne pr\u00edpady&#8230; V jednom pr\u00edpade ide o snahu za ka\u017ed\u00fa cenu presadi\u0165 cca 5 rokov prev\u00e1dzkovan\u00e9ho chovu chovu cca 200 ks oviec v strede obce v susedstve rodinn\u00fdch domov za podpory starostu obce a niektor\u00fdch \u00faradn\u00edkov dotknut\u00fdch organiz\u00e1ci\u00ed, ktor\u00ed zrejme nevidia \u010do vidia, a ma\u0161tale vybudovan\u00e9 bez stavebn\u00e9ho povolenia chc\u00fa tie\u017e dodato\u010dne povoli\u0165 v rozpore s pr\u00e1vnymi predpismi a normami&#8230; T\u0155nist\u00e1 cesta susedov za svojimi pr\u00e1vami za\u010dala pred piatimi rokmi a a\u017e teraz sa dostala ku n\u00e1m a na s\u00fad&#8230; <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span class=\"style-scope yt-formatted-string\" dir=\"auto\">Druh\u00fd pr\u00edpad u\u017e \u0161iesty rok star\u00fd sa ku n\u00e1m dostal pred dvomi rokmi a\u017e po v\u00fdroku s\u00fadu a zah\u00e1jen\u00ed exek\u00facie na odstr\u00e1nenie k\u013e\u00fa\u010dovej statickej \u010dasti stavby zrubovej drevenice. Stavebn\u00fd \u00farad vydal riadne stavebn\u00e9 povolenie, stavebn\u00edk stavbu vybudoval, po\u017eiadal o kolaud\u00e1ciu a sused si zmyslel, \u017ee k\u00fasok strechy asi cca 30 cm presahuje nad jeho pozemok. Stavebn\u00fd \u00farad nelenil, ni\u010d si neoveril z tvrdenia suseda a v rozpore so z\u00e1konom doplnil suseda do kolauda\u010dn\u00e9ho konania, preru\u0161il kolaud\u00e1ciu a poslal suseda a stavebn\u00edka na s\u00fad&#8230; S\u00fad aj v\u010faka ned\u00f4sledn\u00e9ho zastupovania stavebn\u00edka advok\u00e1tom stavebn\u00edk s\u00fad prehral, preto\u017ee nikto nedal overi\u0165 skuto\u010dn\u00fa hranicu parciel medzi susedom a stavebn\u00edkom. S\u00fad vydal exeku\u010dn\u00e9 rozhodnutie a my sme sa do tohto koloto\u010da dostali a\u017e ex post po vydan\u00ed exeku\u010dn\u00e9ho rozhodnutia v nov. 2021. Zatia\u013e sme dosiahli nevykonate\u013enos\u0165 exek\u00facie, preto\u017ee by do\u0161lo k z\u00e1sadn\u00e9mu po\u0161kodeniu a\u017e zni\u010deniu stavby a v\u00fdkon rozhodnutia by sp\u00f4sobil v\u00e4\u010d\u0161ie majetkov\u00e9 a spolo\u010densk\u00e9 \u0161kody, ako \u00fadajn\u00fd presah strechy nad \u00fadajn\u00fdm miestom &#8211; trasou hranice medzi parcelami sporn\u00fdch str\u00e1n. Znaleck\u00fd posudok geodeta preuk\u00e1zal, \u017ee naopak, sused u\u017e\u00edva cca 30 cm parcely stavebn\u00edka a keby aj bola hranica spr\u00e1vne, existuje povolen\u00e1 tolerancia geodetick\u00e9ho merania pod\u013ea ktorej aj tak strecha nepresahuje ani fikt\u00edvnu hranicu, ktor\u00fa sused zle pre\u010d\u00edtal a na z\u00e1klade \u010doho podal s\u0165a\u017enos\u0165 na stavebn\u00fd \u00farad. T\u00fdm, \u017ee stavebn\u00fd \u00farad prizval suseda do kolauda\u010dn\u00e9ho konania, stavebn\u00fd \u00farad poru\u0161il z\u00e1kon 2x a to \u00a7 78 ods. (1) ktor\u00fd jasne ustanovuje, \u017ee \u00fa\u010dastn\u00edkmi kolauda\u010dn\u00e9ho konania s\u00fa stavebn\u00edk, vlastn\u00edk stavby, ak nie je stavebn\u00edkom a vlastn\u00edk pozemku, na ktorom je stavba umiestnen\u00e1. Nikto viac. \u010ealej, je vo v\u00fdlu\u010dnej kompetencii tak\u00fdto spor rie\u0161i\u0165 Stavebn\u00e9ho \u00faradu a nie s\u00fadu. Toto je technick\u00e1 vec, na ktorej rie\u0161enie s\u00fa ur\u010den\u00e9 stavebn\u00e9 \u00farady, ale v tomto pr\u00edpade je kuri\u00f3zne, \u017ee s\u00fad prijal tak\u00fdto spor a rie\u0161il ho v podstate v rozpore so z\u00e1konmi a zdrav\u00fdm rozumom a\u017e po exeku\u010dn\u00e9 rozhodnutie. <\/span><\/p>\n<p><span class=\"style-scope yt-formatted-string\" dir=\"auto\">V s\u00fa\u010dasnosti m\u00e1 stavebn\u00fd \u00farad na stole u\u017e vy\u0161e mesiaca \u010fal\u0161iu v\u00fdzvu advok\u00e1ta stavebn\u00edka s \u010fal\u0161\u00edm na\u0161\u00edm stanoviskom na vydanie kolauda\u010dn\u00e9ho rozhodnutia, preto\u017ee stavebn\u00edk splnil u\u017e v\u0161etky podmienky aj tie dodato\u010dn\u00e9, ktor\u00e9 neboli predmetom povo\u013eovacieho stavebn\u00e9ho konania, ale stavebn\u00fd \u00farad ich \u017eiadal ako podmienku na vydanie rozhodnutia. V\u0161etko nasved\u010duje tomu, \u017ee stavebn\u00fd \u00farad rob\u00ed zatia\u013e v\u0161etko preto, aby komusi vyhovel a kolauda\u010dn\u00e9 rozhodnutie nevydal. Dokonca sa nechtiac pri osobnom rokovan\u00ed vyjadril v tom zmysle, \u017ee zru\u0161\u00ed p\u00f4vodn\u00e9 stavebn\u00e9 povolenie&#8230; Jednoducho svinstvo a bezoh\u013eadnos\u0165, ktor\u00e9 treba postihova\u0165 a rie\u0161i\u0165.
